Terms of Service
Please read these terms carefully before using OpenALaCarte.

1. Acceptance
By accessing or using OpenALaCarte (the «Service»), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of service
OpenALaCarte provides software and a marketplace for hospitality businesses — restaurants, shops, hotels, event venues and commercial kitchens. In these Terms, «Venue» means any such business listed on the platform. The Service covers discovery, booking, online ordering, menu and catalogue management, stays, event hire and kitchen operations, and is provided on an «as is» and «as available» basis.
3. Accounts
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at security@openalacarte.com if you suspect unauthorised access.
4. Venue partners
Venues using the platform — restaurants, shops, hotels, event venues and commercial kitchens — are independent businesses. OpenALaCarte is not a party to any transaction between you and a Venue. Disputes regarding food, service, accommodation, event delivery or fulfilment must be resolved directly with the Venue. We are responsible for operating the platform itself with reasonable care and skill — that your order or booking is transmitted accurately to the Venue, and that payments are processed and accounted for correctly. That responsibility is not excluded by this section.
5. Bookings and orders
Bookings, stays and orders are subject to Venue availability and confirmation. Where we collect payment, we do so as the Venue's agent — payment to us discharges your obligation to pay the Venue. All charges are displayed in the applicable currency, inclusive of VAT where required by law.
6. Cancellations and refunds
Cancellation and refund terms are set by each Venue and shown to you before you book or order. Where a Venue authorises a refund, we process it back to your original payment method; timing then depends on your bank or card issuer. Because your contract is with the Venue, refund decisions about food, service or a stay are the Venue's to make — we can help you reach them. Nothing here limits your statutory rights, including any right to a refund where goods or services are not as described.
7. Allergens and dietary information
Allergen, ingredient and dietary information shown on the platform is provided by the Venue, not by us, and we do not independently verify it. Kitchens handle many ingredients, so cross-contact is possible even where an allergen is not listed. If you have a food allergy or intolerance, tell the Venue directly before you order and confirm at the point of service — do not rely solely on the information shown here.
8. Prohibited conduct
You may not: scrape or crawl the platform, submit false or fraudulent bookings, circumvent security measures, post unlawful or harmful content, or use the Service in violation of applicable law.
9. Intellectual property
All platform content, trademarks, and software are owned by or licensed to OpenALaCarte. You may not reproduce, distribute, or create derivative works without prior written consent.
10. Limitation of liability
To the extent permitted by law, our liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights as a consumer.
11. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your country of residence.
12. Changes
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be notified by email 30 days in advance.
